A contribution to a festschrift for Prof. Rosemarie Will analysing a previously ignored paradigm shift in the debate about data protection which took place in the 1970s. While the privacy debate takes the object of protection – privacy, Privatheit, Privatsphäre, digital intimacy – as a starting point, the first generation of data protection scholars in Germany realized at the beginning of the 1970s that the analytical perspective needed to be changed fundamentally for a thorough analysis of the data protection problem. Not the outdated notion of categorically separate spheres should be used as the starting point for the analysis, but the specific practices of modern organized information processing and their properties.
