Empirische Urheberrechtsforschung

In den vergangenen 20 Jahren hat sich das Urheberrecht von einem hochgradig spezialisierten Nischen-Thema für Experten zu einem der hoch politisierten und umstrittenen Themen der Medien- und Internetpolitik entwickelt. Die Debatte wird dabei überwiegend aus juristisch-normativer Perspektive geführt. Dabei gerät die Frage, wie das Recht in der Praxis von Innovations- und Schaffensprozessen überhaupt wirkt, mitunter in den Hintergrund. Welche Anreize setzt das Urheberrecht in der Schaffung kreativer Werke? Welche anderen Handlungsorientierungen spielen für Kreative eine Rolle und wie verhalten sie sich zum Recht? Brauchen Medienprodukte starke Schutzrechte zur Erlösgenerierung? Wie lässt sich zwischen legitimer Inspiration und problematischer Nachahmung unterscheiden?

 

Welche Rolle spielt das Urheberrecht in der kreativen Praxis?

 

Der Projektbereich Empirische Urheberrechtsforschung adressiert durch konzeptionelle Arbeiten und empirische Fallstudien drängende Fragen zur Rahmung und Regulierung kreativer Prozesse und der Zirkulation von digitalen kreativen Werken. Konzeptuell leisten wir einen Beitrag zur empirischen Urheberrechtsforschung, indem wir eine Governance-Perspektive entwickelt haben, die verschiedene Formen der Rahmung und Regulierung berücksichtigt. Denn das Urheberrecht ist nicht allein. Auch Diskurse, informelle Normen, Technologien und Geschäftsmodelle beeinflussen, in welcher Weise wir kreative Werke erschaffen werden, wie sie zirkulieren und wie wir sie nutzen. Empirische Studien adressieren den Handel von TV-Formaten, die Entwicklung digitaler Spiele und Online-Plattformen.
