Sebastian Leuschner, Dr.

Sebastian Leuschner studied European Studies at Otto-von-Guericke-University Magdeburg and at Södertörns Högskola in Stockholm as well as Law at Humboldt-Universität zu Berlin. During his studies he focussed on issues of European und International Law. In September 2013 he started as a doctoral researcher at Alexander von Humboldt Institute for Internet and Society.

The EU’s fundamental rights not only set limits to measures of public authorities but also oblige them to take measures necessary to protect individual freedoms. This is true in particular with regards to the field of IT-security, first and foremost to secure individual privacy. However, the EU lacks an explicit competence for such issues, although, due to its transnational dimension, the member states obviously cannot guarantee IT-security anymore. Hence, on the one hand, potentials of existing European competences need to be exploited. On the other hand, besides norms limiting the scope of existing competences, such as Art. 4 para. 2 TEU, the Fundamental Rights Charter contains several restrictions in order to avoid a too far-reaching interpretation of existing competences. The project deals with the tension between these opposing principles in European law.
